In these Conditions K. B Real Estate Company Limited, who act as auctioneers and agents for the vendor are called The Auctioneers and the representative of K. B Real Estate Company Limited conducting the auction is called The Auctioneer.
Whilst K. B Real Estate Company Limited makes every effort to ensure the accuracy of their catalogue and the description of any lot:
(a) Each lot as set out in the catalogue is sold by the vendor with all faults, imperfections and errors of description.
(b) All statements whether printed in the catalogue or made orally are statements of opinion only and are not to be taken as being or implying any warranties or representations of fact by
- KB Real Estate Company Limited, unless they have been instructed in writing by the vendor so to certify, and in such cases the Auctioneers do so as agents of the vendor and are not themselves responsible for such claims.
Once you have checked out, payment is to be made by Scotia online transfer to K.B. Real Estate Company Ltd. Account 3126 at 21725 – Constant Spring Financial Center
Each buyer indicating an intention to buy a lot acknowledges that he has satisfied himself fully before bidding by inspection or otherwise as to all of the Sale Conditions, the physical condition and description of the lot including but not restricted to whether the lot is damaged or has been repaired or restored.
- PROPERTY AND RISK
(a) Legal Title will not pass to the buyer until the lot(s) has (have) been paid for in full and the Auctioneers shall be entitled to a lien on any lot sold until the purchase price is paid in full but each lot is at the sole risk of the buyer from the acceptance of the offer. Each buyer shall forthwith give his full name and permanent address and if called upon to do so by the Auctioneer shall forthwith pay to K. B Real Estate Company Limited the sale price of the lot or a sum of money that the Auctioneer may require. If the buyer fails to do so, the lot may at the Auctioneers sole discretion be put up again and re-sold.
- Each prospective purchaser shall be deemed to act as principal unless there is in force to the sale a written acknowledgment by K. B Real Estate Company Limited that the agent acts on behalf of the named principal.
- REMOVAL OF GOODS
All lots must be paid for in full before delivery and be taken away at the purchaser’s expense.
- THE CATALOGUE
The catalogue is intended as a guide only and no warranty expressed or implied is given in regard to any lot in respect to the accuracy of the description its age, size, quantity condition or usefulness and the purchasers will be presumed to have satisfied themselves in respect to each item prior to placing their bid.
